I. INTRODUCTION
Frozen Liquid's (Acceptable Use Policy (the "AUP") is in place
to protect Frozen Liquid and its customers from activities which
may be irresponsible, illegal, or offensive. The AUP is a list of actions
which are strictly prohibited upon using the services provided by Frozen
Liquid.
II. VIOLATIONS OF FROZEN LIQUID'S ACCEPTABLE USE POLICY
1. Transmission, storage and/or distribution of any material that is
in violation of any law or regulation is strictly prohibited. This includes
copyrights, trademarks, or any intellectual property right used without
proper authorization.
2. Sites containing adult material, links to adult material or adult-oriented
merchandise are prohibited. The final determination of what constitutes
"adult content' will be made only by Frozen Liquid.
4. Customers agree that Frozen Liquid solely reserves the right to remove
and destroy any materials that may be illegal, offensive or fail to conform
with this agreement. Frozen Liquid reserves the right to remove any such
material without prior notice or consent.
3. Customers agree that Frozen Liquid reserves the right, and will exercise
the right, to report any and all illegal activities to government authorities
for prosecution. Frozen Liquid will exercise its right to prosecute all
violators to the fullest extent of the law.
4. Frozen Liquid's user accounts may not be transferred or used by anyone
but Frozen Liquid's customers, with the exception of reseller programs.
Users may not resell any storage space provided by Frozen Liquid. Users
may not resell bandwidth or parts of their bandwidth without the written
consent of Frozen Liquid's representatives. Frozen Liquid also reserves
the right to impose any additional charges to excessive bandwith use with
or without notification. The additional charges may vary depending on
which package is selected. Bandwidth plans are liable to change with or
without prior notice.
5. The installation, compilation, use, implementation, or distribution
of Robots, Bots, Mail Bombs, Syn Bombs, Spamming, or any other process
which consumes excess amounts of bandwidth and/or system resources is
strictly prohibited. Any automated process that takes up excessive system
resources or processes in which other users may be effected is strictly
prohibited. Violation of this agreement will result in immediate cancellation
of service.
III. LIMITATION OF LIABILITY
Frozen Liquid will in no way be responsible for damages of any kind which
may arise from Frozen Liquid servers going offline or being unavailable
for any reason. Frozen Liquid shall also not be responsible for the loss,
corruption, or deletion of data from Frozen Liquid's servers.
IV. REPORTING VIOLATIONS OF FROZEN LIQUID AUP
Frozen Liquid requests that anyone who believes that somebody is in violation
of this agreement will contact our abuse department at abuse@frozenliquid.net.
This information will in turn help us to better provide service to all
of our customers.
Please try to provide the following information with reporting abuse.
Time and date of the abuse (If applicable)
IP address of the violator (If applicable)
URL of materials in violation with this agreement (If applicable)
Any server logs with evidence of the violation (If applicable)
Any other information you think may aid us in resolving the issue.
V. REVISIONS TO THIS ACCEPTABLE USE POLICY
Frozen Liquid reserves the right to make changes to this policy effective
on the date which the revision was posted.
